ORDER
This Criminal Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, ‘the BNSS’) by the petitioner/accused No.2 against the order, dated 22.11.2023 passed in Crl.M.P.No.2080 of 2023 in C.C. No. 11072 of 2022 on the file of XIV Additional Chief Metropolitan Magistrate, Nampally, Hyderabad. By the impugned order, the petition filed by the petitioner for renewal of the Passport, was dismissed.
2. Heard Sri M.A.Mujeeb, learned counsel for the petitioner and Sri Arun Kumar Doddla, learned Additional Public Prosecutor for respondent – State.
3. Learned counsel for the petitioner submitted that though the petitioner’s passport was not deposited before the trial Court, the passport authorities seeking no objection certificate from the concerned Court as there are criminal case proceedings pending against the petitioner. Hence, he prayed the Court to direct the trial Court to provide no objection certificate only to the extent of renewal of his passport.
4. On the other hand, learned Additional Public Prosecutor for respondent – State submitted no objection only to the extent of renewal of the petitioner’s pass
