THE HONOURABLE SRI JUSTICE E.V. VENUGOPAL CRIMINAL PETITION No.4987 OF 2025

ORDER:

This Criminal Petition is filed to quash the proceedings against the petitioner/accused No.7 in SC NDPS No.144 of 2023 on the file of the Metropolitan Sessions Judge, Nampally at Hyderabad.

2. Heard Mr.K.R Sunil Kumar, learned counsel for the petitioner and Mr.E.Ganesh, learned Assistant Public Prosecutor of the respondent No.1-State.

3. The brief facts of the case are that on reliable information about illegal possession and selling of Narcotic Drugs at GHMC ground, Musheerabad, on 28.10.2022 the Inspector of Police, Musheerabad Police Station, surprised the spot and found accused No.3 in possession of dry ganga weighing about 1.10 Kgs, 3 chocolate bars mixed with hash oil and small empty sachets and recorded confessional statement of the accused in the presence of the Gazetted Officer and Mediators. The main allegation levelled against the petitioner-accused No.7 is that he is the consumer. After completion of investigation, the police filed the charge sheet against the accused for the offence under Section 8 (c) read with 20 (b) (ii)(B) and 27 of NDPS Act.
