ORDER:
This Criminal Petition is filed under Section 528 of BNSS by the petitioner/accused, to quash the proceedings in FIR No.414 of 2025, dated 13.03.2025 on the file of the Madhapur Police Station, Cyberabad, registered for the offences under Sections 406, 420 and 506 of IPC.
2. Heard learned counsel for the petitioner and Sri M.Vivekananda Reddy, learned Assistant Public Prosecutor for respondent No.1– State. Perused the record.
3. On perusal of the record, since the punishment prescribed for the offences alleged against the petitioner is upto seven (07) years, this Court deems it appropriate to direct the petitioner to appear before the Investigating Officer in FIR No.414 of 2025, dated 13.03.2025 on the file of the Madhapur Police Station, Cyberabad. The Investigating Officer is directed to follow the procedure laid down under Section 35(3) of BNSS (previously, Section 41-A of Cr.P.C.) and also the guidelines formulated by the Hon’ble Supreme Court in Arnesh Kumar v.
