HON’BLE SMT. JUSTICE JUVVADI SRIDEVI I.A.Nos.3 and 4 of 2025 in/and CRIMINAL REVISION CASE No.1405 of 2014

COMMON ORDER:

Challenging the judgment dated 26.06.2014 passed in Criminal Appeal No.514 of 2012 by the learned V Additional Metropolitan Sessions Judge (Mahila Court) at Hyderabad, this Criminal Revision Case is filed. By the impugned order, the judgment dated 19.05.2012 passed in C.C.No.13 of 2007 by the learned XIII Additional Chief Metropolitan Magistrate (Mahila Court) at Hyderabad, was confirmed, wherein, the petitioner- appellant-accused No.1 was convicted for the offence under Section 498-A of IPC and he was sentenced to undergo rigorous imprisonment for three years and also to pay a fine of Rs.5,000/-, in default to undergo simple imprisonment for six months.

It is submitted by learned counsel appearing for the petitioner as well as the respondent No.2, that during pendency of the present Criminal Petition, the parties have compromised the matter and the petitioner and respondent No.2 are living together. Accordingly, I.A.Nos.3 and 4 of 2025 have been filed to record the compromise between them, to compound the offences and to set aside the order of conviction.

3. Vide order dated 22.04.2025, this Court directed the parties along with their respective counsel to appear before the Secretary, High Court Legal Services Committee, High Court for the State of Telangana, Hyderabad, for identification and to submit a report.

4. Pursuant to the above said direction issued by this Court, the parties have appeared and the Secretary, High Court Legal Services Committee, has identified the parties and submitted a report, dated 26.04.2025 and the same is placed on record.

5. The spouses i.e., the petitioner and the 2nd respondent have resolved their issues. According to learned counsel appearing for both the parties, presently, the petitioner and the 2nd respondent are living together. In view of the same and considering the report, dated 26.04.2025, I.A.Nos.3 and 4 of 2025 filed to compound the offences and compromise the matter are allowed. Consequently, this Criminal Revision Case is allowed and the conviction and sentence of imprisonment imposed against the petitioner-appellant-accused No.1 in the judgment dated 26.06.2014 passed in Criminal Appeal No.514 of 2012 by the learned V Additional Metropolitan Sessions Judge (Mahila Court) at Hyderabad, confirming the judgment dated 19.05.2012 passed in C.C.No.13 of 2007 by the learned XIII Additional Chief Metropolitan Magistrate (Mahila Court) at Hyderabad, is hereby set aside. The bail bonds of the petitioner-appellant-accused No.1 shall stand cancelled.

Miscellaneous applications, if any pending, shall stand closed.
