ORDER:
This Criminal Petition is filed by the petitioner praying the Court to direct the trial Court to dispose of the petition filed under Section 391 of Cr.P.C, in Crl.A.No.243 of 2022 on the file of Sessions Judge, Nampally at Hyderabad.
2. Heard Sri T.Ravinder Rao, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent.
3. The petition under Section 391 of Cr.P.C, was filed by the petitioner herein to recall Pw.1 for the purpose of cross- examination to elicit the truth and to bring out the real facts. Petitioner also wanted to file certified copy of sale deed, bank Statement and police report and complaint filed with SRO, against the de facto complainant alleging non-receipt of part sale consideration under the alleged sale deed, to prove his innocence. He further contended that the said petition was filed in September, 2024 and the same is not disposed of till today by the appellate Court. Hence, prayed this Court to direct the trial Court to dispose of the said petition as expeditiously as possible.
4. Considering the submissions made by the learned counsel for the petitioner, without going into merits of the case, the trial Court is directed to dispose of the petition filed by the petitioner under Section 391 of Cr.P.C, in accordance with law at the earliest.
5. With the above direction, the Criminal Petition is disposed of.
Miscellaneous petitions, pending, if any, shall stand closed.
