ORDER:

This writ petition is filed seeking following relief:

“For the reasons stated in the accompanying affidavit it is prayed that this Honorable Court be pleased to issue a Writ, Order or direction more in the nature of Mandamus declaring the action of the respondents in not conducting survey and fixing boundaries to the lands of the petitioners in respect of 1st petitioner in Sy.No.42/A and 46/2AA to an extent of Ac.2.26, and land in Sy.No.38/AA/1 and 40/AA/1 and 41/AA/1 to an extent of Ac.2.13 gts of the 2^nd petitioner, and land in Sy.No.42/AA/3, 43/A/3 and 46/AA/2 to an extent of Ac.2.13 gts in respect of 3^rd petitioner and land to an extent of Ac.2.22 gts in Sy.No.42/VU, 43/VU and 46/VU in respect of 4th petitioner and land in Sy.No.42/VU, 43/VU and 46/2/VU to an extent of Ac.2.22 gts in respect of 5^th petitioner and land in Sy.No.42/VU, and 46/2/VU to an extent of Ac.2.13 gts in respect of 6^th petitioner situated at Rachannagudem Village of Mulakalapallim Mandal of Bhadridri Kothagudem inspite of submitting online F-Line applications on 22.1.2025 and issuing reminders dt.28.2.2025 to the District Collector, and RDO and to the Tahsildar on 1.3.2025 as illegal, arbitrary violates of Article 19, 21 and 300(A) of Constitution of India and contrary to the provisions of Survey and Boundaries Act and consequently direct the respondents to forthwith conduct the survey and fix the boundaries to the said dispose the appeal along with Stay Application in the interests of justice and to pass such other order or orders as this Hon’ble High Court may deem fit and proper in the circumstances of the case.”

It is stated that petitioners are the owners and pattadars of land admeasuring Acs. 2.26 guntas in Survey Nos.42/A and 46/2AA 46/2/VU (6^th petitioner), situated at Rachannagudem Village of Mulakalapallim Mandal of Bhadridri Kothagudem District and new pattadar passbooks were issued to the petitioners under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2020. It is further stated that the petitioners have submitted f-line applications bearing TTDER Nos.022501131480 & 022501131482 (1^st Petitioner), TTDER Nos.022501131460 & 022501131485 (2^nd petitioner), TTDER Nos.022501131462 & 022501131469 (3^rd petitioner), TTDER Nos.022501131490 & 022501131495 (4^th petitioner), TTDER Nos.022501131453 & 022501131502 (5th petitioner) and TTDER Nos.022501131473 & 02250113176 (6th petitioner) dated 21.01.2025 to the respondents by paying requisite fee to conduct survey of the subject lands and fix the boundaries. The grievance of the petitioners is that even after receiving the said F-Line applications, the respondent authorities are not conducting survey and fixation of the boundaries.

3. Considered the submissions of the learned counsel for the petitioners and learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent this writ petition is disposed of at the admission stage.

4. Learned counsel for the petitioners has submitted that in terms of the circulars issued by the Commissioner, Survey, Settlements and Land Records, the respondents are bound to consider the application within 45 days from the date of the application after collecting necessary charges.

5. Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for the respondents has submitted that the respondent authorities will consider the aforesaid F-Line applications submitted by the petitioners by following due procedure laid down under law and conduct survey and demarcate the subject land by fixing boundaries.

6. It is settled law that the Survey Department has the authority to conduct survey and demarcate lands in accordance with the provisions of the Telangana Land Revenue Act, 1317 Fasli (Act No. VIII of 1317 Fasli), the Telangana Survey and Boundaries Act, 1923, and the Rules framed thereunder.
