ORDER

This Criminal Petition is filed under Section

482 of the Code of Criminal Procedure, 1973 by the petitioners/accused Nos.1 to 3, seeking to quash the proceedings against them in F.I.R.No.231 of 2022 on the file of Bhainsa Town Police Station, Nirmal District, registered for the offence punishable under Section 306 of Indian Penal Code.

2. Heard learned counsel representing petitioners and Mr.E.Ganesh, learned Assistant Public Prosecutor for respondent-State.

3. When the matter is taken up for hearing, learned Assistant Public Prosecutor, by furnishing a copy of written instructions would submit that investigation is completed in this case and charge sheet filed before learned Judicial First Class Magistrate, Bhainsa and P.R.C. number awaited. Therefore, he seeks to dismiss the Criminal Petition as infructuous.

4. Learned counsel for the petitioners concedes to the said request and seeks to grant liberty to file a fresh petition if the cause survives.

5. Recording the submissions made by the learned Assistant Public Prosecutor and taking the copy of written instructions onto the file, the Criminal Petition is dismissed as infructuous. It is needless to mention that the petitioners are at liberty to file a fresh petition if the cause survives. Miscellaneous applications, if any pending, shall also stand closed.
