IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE K.SURENDER
Mr. Karnati Venunath – Appellant
Versus
The State of Telangana – Respondent
CRLP 5858/2025

O R D E R:

This Criminal Petition is filed under Section 528 of Bharatiya Nyaya Sanhita, 2023 (for short “BNSS”) by the petitioners/accused Nos.1 and 2, to quash the proceedings against them in Crime No.322 of 2025 dated 03.04.2025 on the file of Police Station, L.B.Nagar, Hyderabad for the offences alleged against them are under Sections 406, 420, and 506 of IPC.

2. Heard learned counsel for the petitioners and Sri M.Vivekananda Reddy, learned Assistant Public Prosecutor for the respondent – State. Perused the record.

3. Learned counsel for the petitioners submits that the complaint has been filed on false and baseless grounds without any truth and by suppressing and misrepresenting the true facts. It is also contended that the police without verifying and without proper investigation in collusion with the de facto complainant have registered the FIR on false and baseless grounds. It is further contended that the de facto complainant has not produced any document whatsoever to show that he had invested the amounts and that the plots shown to him have double registration and thus requested to quash proceedings against the petitioners.

4. In view of the said submission, the Police are directed to follow the procedure laid down under Section 35(3) of BNSS and also the guidelines formulated by the Hon’ble Supreme Court in Arnesh Kumar v. State of Bihar, (2014) 8 SCC 273 scrupulously. Needless to say, the petitioners shall assist the investigation and shall appear before SHO as and when required, for the purpose of investigation. The Police are also directed to conclude investigation.

5. Accordingly, the Criminal Petition is disposed of.

Miscellaneous applications pending, if any, shall stand closed.
