This Criminal Petition is filed under Section 528 of Bharatiya Nyaya Sanhita, 2023 (for short “BNSS”) by the petitioners/accused Nos.2 and 3, to quash the proceedings against them in F.I.R.No.46 of 2025 dated 26.02.2025 on the file of Police Station, Kondurg, Cybderabad. The offences alleged against him are under Section

108 r/w 3(5) of BNS.

2. Heard learned counsel for the petitioners/accused Nos.2 and 3 and Sri M.Vivekananda Reddy, learned Assistant Public Prosecutor for the respondent – State. Perused the record.

3. Learned counsel for the petitioners submits that the petitioners were falsely implicated in the present crime for the offence under Section 108 r/w 3(5) of BNS.

4. The allegation in the complaint is that the accused No.1 and these petitioners have assaulted the son of the de facto complainant and thereafter abused him stating that it was better if he dies.

5. It is contended that the boy was assaulted with the said utterances by the accused No.1 and these petitioners and went to the fields and consumed pesticides.

6. This Hon’ble High Court stated that any utterances made to ask to go and die comes under Section 306 of IPC.
