ORDER
It is stated that the petitioner is the owner and possessor of the land admeasuring Ac.0.33 guntas forming part of Sy.No.82/1/EE, situated at Jeedimetla Village, Qutubullapur Mandal, Medchal-Malkajgiri District, having purchased the same through registered sale deeds bearing document Nos.15300, 15301, 15302 and 15299 of 2022, dated 20.05.2022; 18880, 18862, 18889 and 18896 of 2022, dated 27.06.2022; 26611 of 2022, dated 23.09.2023 and 30563 and 30564 of 2022, dated 11.11.2022. It is further stated that the vendors of the petitioner have acquired the subject property through partition deed, dated 06.07.2015. It is further stated that when disputes arose between the petitioner and neighbouring pattadars, the vendors of the petitioner filed a suit for bare injunction vide O.S.No.107 of 2016 on the file of the Principal Junior Civil Judge, Medchal and the said Court granted ad interim injunction in I.A.No.435 of 2016, dated 29.08.2016. However, pending the said suit, the petitioner had purchased schedule property. When third parties tried to disturb the boundaries, the petitioner was constrained to file a suit for declaration vide O.S.No.807 of 2022 on the file of the II Additional District and Sessions Judge-cum-I Additional Family Court, Medchal and the said suit is pending. It is further stated that the petitioner also made F-line application, dated 27.05.2024 seeking to conduct survey, demarcation and sub-division of the subject land and acting on the said application, respondent No.5 issued notice, dated 01.06.2024, to conduct survey and demarcation on 07.06.2024. Accordingly, survey was conducted on 07.06.2024 and 08.06.2024 and submitted a report, dated 10.06.2024. It is further stated that despite completion of the survey, no final demarcation or sub-division sketch was issued, as such the petitioners were constrained to file W.P.No.15310 of 2024 before this Court and on the assurance of respondent No.4 to complete the demarcation, the said writ petition was withdrawn. It is further stated that, respondent No.4 issued the impugned endorsement, dated 28.11.2024 vide Lr.No.B/1897/2024, rejecting the application for demarcation of the subject land on the ground that no sub-division records are prepared. Hence, this writ petition.
2. The issue relating to conduct of survey and sub-division of survey etc. was considered by this Court vide order dated 23.08.2022 in W.P.No.32785 of 2022 and the relevant portion of the said order is extracted hereunder:
“8. The Commissioner, Survey, Settlements and Land Records, Hyderabad, has issued various circulars from time to time in connection with conducting of survey, demarcations and sub-division of land and survey numbers and also disposal of F-line petitions submitted by the parties concerned seeking survey and sub-division. The said circulars were issued keeping in view the Board Standing Orders-34A para 20(a) of the Board Standing Orders, which reads as under:-
“Applications from private parties to point out the boundaries of their fields in accordance with the survey records may be received by the Taluk Tahsildar. On receipt of the application with the deposit (prescribed fee), the Tahsildar should forward it to the Surveyor-Firka Deputy Surveyor who should, during his visit to the village, comply with the request. The Surveyor-Firka Deputy Surveyor should after pointing out the required boundary to the ryot, obtain his signature to that effect in the application and should himself (write) thereon that the boundary was pointed out by him in accordance with the measurements noted in the survey records.”
