ORDER

This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS, 2023’) seeking quashment of the proceedings in Crime No.233 of 2025 on the file of the SHO Gachibowli Police Station, Cyberabad District, against the petitioners-accused Nos.2 and 3.

2. The petitioners are arrayed as accused Nos.2 and 3 in Crime No.233 of 2025 registered for the offences punishable under Sections 85, 78, 74 of BNS.

3. Heard Dr.J.Viplav Babu, learned counsel for the petitioner and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1-State.

4. Learned counsel for the petitioners would submit that the petitioners were granted pre-arrest bail. The petitioners are ready to co- operate with the investigation. However, they are being summoned unnecessarily by the police and it is causing hardship to their avocation.

5. Learned Additional Public Prosecutor submits that the petitioners are on bail, investigation is going on, as such, the quashment of the proceedings at this stage would not be proper.

6. Perused the materials on record.

Having regard to the fact that the petitioners are on bail and they are ready to cooperate with the investigation, the investigating officer is directed to seek the presence of the petitioner for investigation in this matter only upon written summons. Further the rights of the petitioners are reserved to file appropriate application after filing final result by the police concerned, this Criminal Petition is disposed of.

Pending miscellaneous applications, if any, shall stand closed.
