HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.12899 OF 2025 ORDER : (ORAL)

This writ petition is filed by the petitioner seeking to declare the action of the respondent authorities to consider his representation dated 18.07.2024 for rectifying the category of CAN:052331730 from commercial to slum domestic (obtained by the father of the petitioner during his lifetime) for H.No.1-8-17/15, and changing the water connection from slum domestic category to commercial without issuing any notice to him, as being illegal, arbitrary and unconstitutional.

2. It is stated that originally the subject property belonged to the father of the petitioner. Later, the brother and sisters of the petitioner transferred the subject property in her favour by virtue of the release deed bearing document No.2310 of 2015. It is further stated that during the lifetime of the father of the petitioner, he obtained water connection vide CAN:052331730 and the subject property has a borewell. After execution of the release deed, the petitioner approached respondent authorities to change the name of the consumer by deleting the name of her father and entering her name. However, respondent authorities did not change the name of the consumer. The subject property comprises of ground + 1 floor; the ground floor comprising of one mulgi was given on lease to a tenant and the 1st floor is occupied by the petitioner for residential purpose. There is no toilet facility for the mulgi in the ground floor, thus, usage of water for commercial purpose does not arise. It is submitted that the petitioner had been paying Rs.388/- (Rupees three hundred and eighty eight only) per month under category of slum domestic connection. However, without issuing any notice to the petitioner, the category has been changed to commercial. Aggrieved thereby, the petitioner submitted representation dated 18.07.2024 for changing the category of water connection but so far no action has been initiated as such, the petitioner is constrained to approach this Court.

3. Mr. Veeresh Kumar, learned Standing Counsel for HMWSSB (Hyderabad Metropolitan Water Supply and Sewerage Board), appearing for respondents No.2 to 6, submitted that appropriate action will be taken on the representation of the petitioner dated 18.07.2024 in accordance with law.

Recording the aforesaid submission, this writ petition is disposed of directing respondents No.3 to 6 to take necessary action on the representation of the petitioner for changing/rectifying the category of water connection, by giving opportunity of hearing to the petitioner and pass orders in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in this writ petition, stand closed.
