ORDER
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C.’) by the petitioners/accused Nos.1 and 2, seeking to quash the proceedings against them in C.C.No.325 of 2023, pending on the file of learned Principal Junior Civil Judge-Cum-Judicial Magistrate of First Class at Medak.
2. After arguing for some time, when this Court has expressed its opinion stating that the raised contentions raised in the petition are disputed questions of fact which need to be gone into by the trial Court, learned counsel for the petitioners restricted his prayer to the extent of dispensing with the presence of the petitioners before the trial Court.
3. Hence, without going into the merits of the Case, this Criminal Petition is disposed of holding that, if there are no warrants issued against the petitioners, their appearance before the trial Court on each and every date of adjournment is dispensed with unless their presence is specifically required during the course of the trial, subject to the condition that the petitioners being represented by their counsel on every date of hearing.
