THE HON’BLE SRI JUSTICE PULLA KARTHIK WRIT PETITION No.10224 OF 2025

O R D E R:

This Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“...to issue a Writ, Order or Direction more particularly in the matter of Writ of Mandamus, declaring the action of the 2nd respondent in not numbering the revision petition filed by the petitioner and not heard the appeal and not passed the any orders keep on pending revision from 24.03.2025 which was filed against the orders passed by the 3^rd respondent in CMA No.46/2024 dt.06.02.2025, keep on pending the revision by the 2^nd respondent without passing any orders or hearing the appeal is highly illegal, arbitrary and against the principles of natural justice and also violative of Articles 14, 19, 21 and 300-A of Constitution of India by setting aside the Order of the 3rd respondent dated 06.02.2025 and consequently direct the respondents not to dispossess the petitioner from the land in question in Sy.No.264/1/163 /AA to extent of Ac.2.231½ gts out of Ac.3.20 gts of Hemachandrapuram village, Karukonda Revenue Village, Laxmidevipalli Mandal, Bhadradri Kothagudem District in the interest of justice and to pass...”

Heard P.V.Krishnamachary, learned counsel for the petitioner; learned Government Pleader for Tribal Welfare for respondent Nos.1 to 3; and learned Government Pleader for Revenue for respondent Nos.4 and 5. With their consent, this Writ Petition is taken up for disposal at the admission stage itself.

Learned counsel for the petitioner submits that the petitioner is in peaceful possession and enjoyment of the petition scheduled land since long time before 1/70 regulation in Survey No.264/1/163/AA to an extent of Ac.2.231½ guntas out of Ac.3.20 guntas of Hemachandrapuram Village, Karukonda Revenue Village, Laxmidevipalli Mandal, Bhadradri Kothagudem District. The said property is her ancestral property namely Yellavula Guravaiah S/o. Yellavula Papaiah and Yellavula surname families are in peaceful possession and enjoyment of the respective share property. While things stood thus, respondent No.6 filed L.T.R. Case No.31/2022/LDP on the file of Court of Special Deputy Collector (TW), Bhadrachalam, against the petitioner and respondent No.7, who are the granddaughter and grandson of Yellavula Papaiah. Learned Special Deputy Collector (TW), Bhadrachalam, vide order, dated 27.12.2023, held that the provisions of 1/70 regulation are not applicable in the case, hence, it is open for the petitioner therein (respondent No.6 herein) to approach competent Civil Court for redressal of his grievance. Aggrieved by the order, dated 27.12.2023, respondent No.6 filed an appeal vide C.M.A. No.46 of 2024 on the file of Court of Additional Agent to Government, Badrachalam. The Appellate authority, vide order, dated 06.02.2025, has set aside the order, dated 27.12.2023, passed by learned Special Deputy Collector (TW), Bhadrachalam and directed the Tahsildar, Laxmidevipalli, to take over the scheduled land evicting respondent No.1 therein (respondent No.7 herein) and whoever is in possession into government custody under the cover of panchanama and keep the same reserved for future purposes of government. Aggrieved by the same, the petitioner herein preferred revision before respondent No.2 vide C.No.513/TWLTR/25 on 24.03.2025 and the same is pending consideration. Therefore, learned counsel prays this Court to direct respondent Nos.1 and 2 to decide the revision filed by the petitioner, within a stipulated period of time.

4. Learned Government Pleader for the respondents fairly submits that since the revision filed by the petitioner on 24.03.2025 vide C.No.513/TWLTR/25 is pending consideration before respondent Nos.1 and 2, they will pass appropriate orders, in accordance with law.
