WRIT PETITION No.12977 OF 2025

O R D E R:

This Writ Petition is filed, under Article 226 of the Constitution of India, seeking the following relief:

“...to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.5 and 6 in non- considering the representation dated 10.02.2025 of the petitioner and non- initiating to disconnect the power connection in respect of House vide H.No.3-9- 56/4/F, Sharada Nagar, Ramanthapur, Hyderabad is highly illegal, arbitrary, unconstitutional in violation of Principles of Natural Justice and also in violation of Articles 14, 19 (1) (g), 21 and 300-A of the Constitution of India, apart from violation of Electricity Act and consequently direct the respondent No.5 and 6 to consider the representation dated 10.02.2025 of the petitioner and to disconnect the power connection in respect of House vide H.No.3-9-

56/4/F, Sharada Nagar, Ramanthapur, Hyderabad and pass...”

Heard Sri Rapolu Bhaskar, learned counsel for the petitioner; learned Government Pleader for Energy for respondent No.1; and Sri N.Sreedhar Reddy, learned Standing Counsel for Southern Power Distribution Company of Telangana Limited, for respondent Nos.2 to 6. With their consent, this Writ Petition is taken up for disposal at the admission stage itself.

3. Learned counsel for the petitioner submits that the petitioner is the owner and possessor of H.No.3-9-56/4/F, Sharada Nagar, Ramanthapur, Hyderabad and he made a representation to respondent No.4 on 10.02.2025 stating that due to dilapidated condition, he intends to demolish his house and therefore seeks disconnection of the power connection. However, no action has been taken by respondent No.4 so far. Therefore, learned counsel prays this Court to direct respondent No.4 to consider the representation, dated 10.02.2025, submitted by the petitioner and pass appropriate orders, within a stipulated period of time.

4. Learned Standing Counsel for respondent Nos.2 to 6 fairly submits that respondent No.4 will consider the representation of the petitioner, dated 10.02.2025, and pass appropriate orders, in accordance with law.

Having regard to the submissions made by learned counsel for the respective parties and without going into the merits of the case, this Writ Petition is disposed of directing respondent No.4 to pass appropriate orders on the representation, dated 10.02.2025, submitted by the petitioner, strictly in accordance with law, as expeditiously as possible, preferably within a period of three (3) weeks from the date of receipt of a copy of this order and communicate a copy thereof to the petitioner.

Miscellaneous petitions pending, if any, shall stand closed.

There shall be no order as to costs.
