O R D E R

The grievance of the petitioner in the present Writ Petition is that basing on the report made by the petitioner, dt.24.02.2020, the respondents-authorities are not initiating action by registering the FIR against the unofficial respondents herein, which action of the official respondents it is contended as highly illegal and arbitrary.

2. Heard learned Counsel for the petitioner, learned Government Pleader for Home appearing for the official respondents, and perused the record.

3. Having regard to the manner of disposal of the Writ Petition and the nature of lis involved, this Court is of the view that notice to unofficial respondents is not necessary for adjudication of the present Writ Petition.

4. When the matter is taken up for hearing, learned Government Pleader for Home appearing for official respondents submits that the authorities are in receipt of the petitioner’s complaint, dt.25.11.2019, on 24.02.2020 by registered post.

5. Learned Government Pleader further submits that if the petitioner is aggrieved by the inaction of the respondents in causing enquiry and thereafter registering FIR within 14 days, has to avail further remedies provided under Cr.P.C.

6. I have taken note of the respective submissions made.

7. Having regard to the submissions made as above and since, it is not shown to this Court of the petitioner availing further remedies on the respondents-authorities not registering the FIR within 14 days by conducting preliminary enquiry into the contents of the complaint, dt.25.11.2019, which was received by the authorities on 24.02.2020 by registered post, this Court is of the view that the petitioner should be relegated to avail further remedies provided under Cr.P.C.

8. Granting liberty as noted hereinabove, the present Writ Petition is disposed of. No order as to costs.

9. Consequently, miscellaneous petitions, if any, pending shall stand closed.
