O R D E R
Heard learned Counsel for the petitioner, learned Government Pleader for Home appearing for official respondents, and perused the record.
2. The case of the petitioner, in brief, is that though he had approached the 3rd respondent-authority and lodged a complaint, dt.29.09.2018/30.09.2018, the authorities have not registered the FIR, which action of the respondents it is contended as highly illegal and arbitrary.
3. Per contra, learned Government Pleader for Home appearing for respondents submits that a case vide Cr.No.641/2018 has been registered against the petitioner on 20.07.2018, wherein the petitioner was arrayed as accused No.1, and only to get over the aforesaid crime registered, the petitioner has approached the respondents-authorities and lodged a complaint, and as such no action is taken thereon.
4. Learned Government Pleader further submits that if the petitioner is aggrieved by the inaction of the respondents in registering the FIR based on the complaint lodged by the petitioner, dt.29.09.2018/30.09.2018, he is required to avail remedies provided under Cr.P.C.
5. I have taken note of the respective submissions made.
6. Having regard to the submissions made as above and since, a case has been registered against the petitioner vide Cr.No.641/2018, dt.20.07.2018, if the petitioner is aggrieved by the inaction of the respondents in registering a case based on his complaint dt.29.09.2018/30.09.2018, the petitioner has to avail further remedies provided under Cr.P.C., and for the said reason, cannot maintain the present Writ Petition.
7. Granting liberty as noted hereinabove, the present Writ Petition is disposed of. No order as to costs.
8. Consequently, miscellaneous petitions, if any, pending shall stand closed.
