ORDER
This Writ Petition is filed seeking a direction to the respondents No.2 to 4 to take action on the representation of the petitioner dated 26.03.2025 to protect the Gram Panchayat land which is in front of the petitioner’s property.
2. Learned counsel for the petitioner submitted that on the earlier occasion, the petitioner had filed a W.P.No.31857 of 2023 to fill up the pit in front of the petitioner’s property, which belonged to the Gram Panchayat and in the counter filed by the respondents in the said writ petition, the Gram Panchayat had also claimed that the said pit was in Gram Panchayat land. Learned counsel for the petitioner further submitted that the petitioner also admitted the same in the additional counter filed by him before this Court. Learned counsel submitted that the pit has since been filled up, but now the unofficial respondents No.5 and 6 are trying to illegally occupy the same. The grievance of the petitioner is that the petitioner has already submitted a representation dated 26.03.2025 to the respondent No.2 to take action against such illegal encroachment by respondents No.5 and 6, but no action has been taken by the respondents No.2 to 4 so far.
Therefore, the present writ petition has been filed.
3. Heard learned Government Pleader of Panchayat Raj and Rural Development, appearing for respondent No.1, learned Standing Counsel for Gram Panchayat, appearing for respondent No.2 and learned Government Pleader for Revenue, appearing for respondents No.3 and 4.
4. Having regard to the stand of the Gram Panchayat on the earlier occasion that the subject land, in which there was a pit, is the Gram Panchayat land, which is now filled up, this Court deems it fit and proper to dispose of this Writ Petition at the admission stage, directing respondents No.2 to 4 to inspect the site and if it is the Gram Panchayat land, to take action in accordance with law within a period of two (02) weeks from the date of receipt of a copy of this order.
5. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous applications, if any, pending in this writ petition, shall stand closed.
