ORDER
This Criminal Petition is filed under Section
482 of the Code of Criminal Procedure, 1973 by the petitioner/accused, seeking to quash the F.I.R.No.704 of 2023 on the file of Miyapur Police Station, Cyberabad, registered for the offence under Sections 324 and 506 of Indian Penal Code.
2. When the matter is taken up for hearing, learned Assistant Public Prosecutor, by furnishing a copy of written instructions would submit that investigation is completed in this case and charge sheet is filed before learned VIII Additional Metropolitan Magistrate, Kukatpally in C.C.No.1678 of 2023. Therefore, he seeks to dismiss the Criminal Petition as infructuous.
3. Learned counsel for the petitioner concedes to the said request and seeks to grant liberty to file a fresh petition if the cause survives.
4. Recording the submissions made by the learned Assistant Public Prosecutor and taking the copy of written instructions onto the file, the Criminal Petition is dismissed as infructuous granting liberty to the petitioner to move a fresh petition in case the cause survives. Miscellaneous applications, if any pending, shall also stand closed.
