ORDER

Aggrieved by the action of respondent No.3 in not considering the representation of the petitioner for claiming compensation of his lands situated at Chelpur Village, Ghanapuram Mandal, Jayashankar-Bhupalapally District acquired for the purpose of construction of Kakatiya Vidyuth Thermal Kendram and illegal and arbitrary and consequently direct respondents to pay compensation to the petitioners for the subject land acquired by respondent No.3, the present writ petition is filed.

2. Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue (Land Acquisition) on behalf of respondent Nos.1 to 4. With their consent, this writ petition is taken up for disposal at the stage of admission.

3. It is the case of petitioners that respondent No.3 has acquired their lands for the purpose of construction of Thermal Plant in the year 2022 and possession was also taken in the same year. Respondent No.4 i.e., Tahsildar, Ghanapuram Mandal, Jayashankar Bhupalapally District vide endorsement dated 22.10.2024 has clarified that the compensation was not sanction for the subject lands and at present the issue is pending before the Land Acquisition Officer and Revenue Divisional Officer, Bhupalapally. Thereafter, respondent No.4 issued notice in Rc.No.B/190/2020 dated 28.12.2024 informing the petitioners to present on 03.01.2025 at 10.00 AM at their lands and show boundaries and submit the documents in proof of title. The said notice dated 28.12.2024 was issued by respondent No.4/Tahsildar basing on the letter issued by respondent No.3/RDO cum Land Acquisition Officer, hence it shows that respondents have acquired the land of the petitioners in Chelpur Village.

4. The main grievance of the petitioners is that even after 3 years of acquisition of their land, no compensation was paid to them till date. Learned counsel for the petitioner draws attention of this Court to the petition filed before Land Acquisition Officer/Revenue Divisional Officer on 24.12.2024 which is still pending for consideration and pray this Court to pass appropriate order directing the respondent authorities to dispose of the said petition in a time bound manner.

5. Learned Assistant Government Pleader (Land Acquisition) appearing on behalf of respondent Nos.1 to 4 reports no objection in passing such order.

In view of the submissions made above, this writ petition is disposed of with a direction to respondent No.3 to consider the petition filed by petitioners dated 24.12.2024 which is pending for consideration, and pass appropriate orders within a period of one (1) month from the date of receipt of a copy of this order.

7. With the consent of learned counsel on either side, this writ petition is disposed of.

Miscellaneous applications, if any pending, shall stand closed. However, there shall be no order as to costs.
