O R D E R
basing on the complaint made by the petitioner on 18.09.2016, the respondents-authorities are not initiating action by registering the FIR against the unofficial respondent herein, which action of the respondents it is contended as highly illegal and arbitrary.
2. Heard learned counsel for the petitioner, the learned Government Pleader for Home appearing for the official respondents, and perused the record.
3. Despite the petitioner being directed to take out notice to respondent No.4 and file proof of service, the same has not been filed till date. However, having regard to the manner of disposal of the writ petition and nature of lis involved, this Court is of the view that the matter can be proceeded with, without having the audience of the said respondent.
4. When the matter is taken up for hearing, learned Government Pleader appearing for official respondents submits that during the pendency of the Writ Petition, the respondents-authorities based on the complaint submitted by the petitioner dt.18.09.2016 have registered a case vide Crime No.114 of 2016 dt.27.09.2016 and are investigating into Petition stands redressed.
5. Recording the aforesaid submission, the Writ Petition is closed. No order as to costs.
6. Consequently, miscellaneous petitions, if any, pending shall stand closed.
