ORDER
The writ petition is filed to declare the inaction of the respondent No.2 in considering the representation of the petitioner daed 10.04.2025 and not mutating the name of the petitioner in respect of H.No.8-6-167 (PTIN No.1104024985), Block No.6, Revenue Ward No.8, Krishna Nagar, Godavarikhani, Ramagundem Municipal Corporation, Peddapalli, in view of the Will Deed dated
20.10.2023, as being illegal and arbitrary.
2. Heard Mr. VSRMV Prasad Sanaka, learned counsel for the petitioner and Mr. K. Siddharth Reddy, learned standing counsel for the respondent No.2 – municipal corporation.
3. Learned counsel for the petitioner submitted that the father of the petitioner, namely, Meesala Raja Babu, was the absolute owner and possessor of the subject property apart from other properties. The father of the petitioner executed a Will on 20.10.2023 and he died on 14.11.2023 survived by two daughters and one son and the petitioner is elder daughter. The father of the petitioner has settled properties in favour of petitioner’s siblings. The subject property is bequeathed to the petitioner by way of will dated 20.10.2023 executed by her father during his lifetime.
The petitioner applied for mutation to the respondent No.2 on
10.04.2025.
4. Learned standing counsel for the respondent No.2 submitted that mutation cannot be effected on the basis of a Will Deed. The petitioner is required to approach a competent civil Court to declare the Will Deed as valid by making all the legal heirs of the testator as parties.
5. However, learned counsel for the petitioner submitted that there are no disputes between the petitioner and her siblings and if necessary, their no objection affidavits will be filed before the respondent No.2.
6. In view of the above, the writ petition is disposed of with a direction to the respondent No.2 to consider the representation of the petitioner dated 10.04.2025 for mutation of her name in respect of H.No.8-6-167 (PTIN No.1104024985), Block No.6, Municipal Corporation, Peddapalli, by issuing notice to the petitioner; her siblings viz. M. Ravi Kumar (brother), D. Sravanthi (younger sister) and her mother (M. Neetha), R/o. H.No.8-6-167, Mandal, Peddapalli District and pass orders, in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.
The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
