ORDER:
Heard learned counsel for petitioner, learned Assistant Government Pleader for Mines & Geology appearing for 1st and 4th respondents, learned Assistant Government Pleader for Home appearing for 2nd respondent and learned Assistant Government Pleader for Revenue appearing for 3rd respondent. 2. Petitioner is claiming that he is the owner and possessor of the vehicle bearing registration No.AP04 TX 6489 (Goods Carriage-HMV). In proof of the same, he has filed a copy of certificate of registration. The subject vehicle was seized by 2nd respondent on 03.04.2025 on the allegation of illegal transportation of sand. The subject vehicle is in 2nd respondent police station, and it is subjected to sun and rain. However, 2nd respondent is not taking steps to deposit subject vehicle before the learned Magistrate concerned. Therefore, petitioner filed the present Writ Petition to release the subject vehicle.
3. Learned counsel for petitioner would contend that petitioner is ready to comply with Rule 13 of the Telangana State Sand Mining Rules, 2015 (for short ‘the Rules, 2015’), as amended vide G.O.Ms.No.15, dated 19.02.2015.
