ORDER:

This writ petition is filed by the petitioner seeking the following relief:

“……to issue writ order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the impugned action of the respondents in not issuing the appointment and posting orders to the petitioner as per his merit and ranking as S.G.T Special Education though submitted all the relevant Certificates and dodging the issue for the reasons best known to them which is clearly illegal, arbitrary, discriminatory, unjust and contrary to the qualifications prescribed in DSC-2024 Notification and violation of Articles 14 and 21 of the Constitution of India and consequently declare that the petitioner is entitled to be given appointment and posting orders as per merit ranking in DSC-2024 as SOT Special Education with all consequential benefits and to pass such other order or orders...”

2. Heard Mr. Suresh Allika, learned counsel for the petitioner, learned Government Pleader for School Education appearing for respondent Nos.1 to 4 and Mr. G.Praveen Kumar, learned Deputy Solicitor General of India appearing for respondent No.5. Perused the material available on record.

The present writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking a direction to the respondents to issue appointment and posting orders to the petitioner for the post of Secondary Grade Teacher (Special Education - Telugu) in Warangal District, pursuant to the Direct Recruitment Notification No.24/RC-1/TRT/DSC/2024, dated

29.02.2024 issued by respondent No.2.

Learned counsel for the petitioner submits that the petitioner belongs to the Scheduled Tribe (ST) category and possesses all requisite academic and professional qualifications including S.S.C., Intermediate, Graduation, and obtained Diploma in Early Childhood Special Education (Mental Retardation) in the year 2011, along with an additional qualification in the year 2013. It is further submitted that the petitioner is duly registered with the Rehabilitation Council of India (RCI) under CRR No.B34665, which remains valid until 02.11.2029. Pursuant to the said notification, the petitioner applied for the post of SGT (Special Education – Telugu) in Warangal district and was issued Hall Ticket No.245173181758. He appeared in the written examination held on 20.07.2024 and secured 52.27 marks, obtaining 10th rank in the District.

Learned counsel for the petitioner further submits that the petitioner was shortlisted in the ratio of 1:3 and was called for certificate verification, which was conducted from 29.10.2024 to 30.10.2024. He submitted all his original certificates, including proof of RCI registration. However, due to a technical issue with the RCI website, the updated certificate reflecting the special course could not be downloadable at that time. Nevertheless, the petitioner's registration had already been approved by the RCI on 25.10.2024. It is further submitted that upon successful downloading of the updated RCI certificate on 04.11.2024, the petitioner promptly submitted the same to the concerned authorities on 05.11.2024. Despite this, appointment and posting orders were not issued to the petitioner.

Learned counsel for the petitioner further submits that candidates in other districts who were similarly situated and had submitted their RCI certificates post-verification were duly considered and issued appointment orders. However, the petitioner has been subjected to discriminatory treatment arising solely from a technical delay that was beyond his control.

Learned counsel for the petitioner further submits that respondent No.4 addressed a letter dated 12.11.2024 bearing Lr.Rc.No.3052/A1/DSC/2024 to respondent No.2, acknowledging the petitioner's eligibility and seeking clarificatory orders regarding his appointment. However, no action has been taken by respondent No.2 till date.
