ORDER:

This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS, 2023’) seeking quashment of the proceedings in FIR No.1318 of 2024 of Police Station Cyberabad, against the petitioners/accused Nos.1 & 2.

2. Heard Smt. Ch.Kanaka Durga, learned counsel for petitioners and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1-State.

3. The petitioners are accused Nos.1 & 2 for the alleged offences under Sections 318(4), 316(2), 351(2) BNS.

4. Learned counsel for the petitioners submits that a false case has been foisted and as such, proceedings are liable to be quashed.

5. Learned Additional Public Prosecutor submits that during the course of investigation, the petitioner/accused No.1 was arrested and later released on bail and petitioner/accused No.2 has obtained pre-arrest bail and the investigation is underwent.

Having regard to the contentions of the police report and the allegations against the petitioners, as the investigation is under progress, reserving the right of the petitioners to file appropriate application after filing of the charge sheet and if a positive case is made out in their favour, this Criminal Petition is disposed of.

Miscellaneous petitions, pending if any, shall stand closed.
