ORDER:

This writ petition is filed seeking following relief:

“For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon’ble Court may be pleased to issue a Writ, order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 2 to 4 in not entering the name of the petitioner in the Online portal and not issuing the Pattedar Passbook in favour of the petitioner, with respect to the land of the petitioner in Survey No.418/AA/2 to an extent of Ac.0-20 Gts. situated at Tangatur Village, Shankarpally Mandal, Ranga Reddy District, Telangana State as illegal, improper, arbitrary, unjust, violative of principles of natural justice, violative of articles 14, 21 and 300-A of the Constitution of India and consequently direct the respondents 2 to 4 to enter the name of the petitioner in the Online portal and issue the Pattedar Passbook in favour of the petitioner, with respect to the land of the petitioner in Survey No.418/AA/2 to an extent of Ac.0-20 Gts. situated at Tangatur Village, Shankarpally Mandal, Ranga Reddy District, Telangana State by considering the application made by the Petitioner before the Dharani Grievance vide transaction ID. 30T637700003274 Dt. 06.11.2024 and to pass such other order or orders as this Hon’ble Court may deems fit just and proper in the circumstances of the case.”

It is stated that the petitioner is owner and possessor of the land admeasuring Acs. 2.07 guntas in Survey No.418/AA/2, situated at Tangatur Village, Shankarpally Mandal, Ranga Reddy District (for short, ‘the subject property’), having purchased the same under registered sale deed dated 09.12.2019 vide Document No.13051 of 2019. It is further stated that the petitioner’s vendor names were recorded as pattadars and pattadar passbook and title deeds were issued to them as per the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971. It is further stated that soon after purchasing the subject property, petitioner has submitted an application dated 15.03.2024 on the file of the respondents to change the name of his vendors and to incorporate his name in the revenue records. The grievance of the petitioner is that he has made an online application in Dharani Portal dated 06.11.2024 vide Transaction ID.No.30T637700003274 to incorporate the name of the petitioner and for mutation and consequential issuance of the pattadar passbook in favour of him, but the same was not considered by the respondents. Hence, the present writ petition.

3. Considered the submissions of the learned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this writ petition is being disposed of at the admission stage.

The learned Assistant Government Pleader for Revenue appearing for respondents has submitted that Telangana Rights in Land and Pattadar Passbooks Act, 2020 (for short “the Act 9 of 2020”) has been repealed and replaced with Telangana Bhu Bharati (Record of Rights in Land) Act, 2025 (for short “the Act 1 of 2025”) and if the petitioner submits online application in the prescribed format in Bhu Bharati Web Portal and if the same fulfills all the requirements of the Act 1 of 2025 and the Rules made thereunder, the respondent authorities will consider the same, in accordance with law.

In view of the above submissions, this Court without expressing any opinion on the right and entitlement of the petitioner, since it is stated that the petitioner has made an online application dated 06.11.2024 in the prescribed format in Dharani Portal vide Transaction ID.No.30T637700003274, the ends of justice would be met if the respondents are directed to consider the said online application of the petitioner dated 06.11.2024 vide Transaction ID.No. 30T637700003274.
