THE HONOURABLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No.4993 of 2025

ORDER:

This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short ‘BNSS’) seeking anticipatory bail to the petitioner/accused No.2 in Crime No.124 of 2025 on the file of Film Nagar Police Station, Hyderabad Commissionerate registered for the offences punishable under Sections 318(4), 336(3), 340(2), 341(2), 61(2), 111 (iv) r/w 3(5) of the Bharatiya Nyaya Sanhitha, 2023 (for short ‘BNS’).

The case of the prosecution is that on 16.02.2025 at 1900 hours, the Sub-Inspector of Police, P.S.Film Nagar, Hyderabad while conducting patrolling at Shaikpet Nala within the limits of Film Nagar Police Station, found Accused No.5 in suspicious circumstances while carrying a coger in his hands and on seeing the Police, A-5 tried to run away but, the Police could apprehend him an don checking the cover found some Educational Certificates of various Universities. On enquiry, the Accused No.5 disclosed his identity and confessed that the said certificates are fake and that the persons who required such fake certificates used to contact him and then he used to contact accused No.4, who in turn was securing such fact certificates from accused No.3. In the confessions of accused No.3 to accused No.8, the role of accused No.1 and petitioner/accused No.2 who are the main manufacturers and suppliers of the fake educational certificates has come into light. Basing on the same, Crime No.124 of 2025 was registered.

3. Heard Mr.B. Akash Kumar, learned counsel for the petitioner and Mr.Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner has not committed the offence and he was falsely implicated in the above crime basing on the confession statement of other accused and the same is not permissible under law. Even according to the Remand case diary investigating officer already recorded the statements of the witnesses and also statement of accused Nos.3,4,6,7 and 8 and except filing of the charge sheet nothing remained. He further submitted that the petitioner shall abide by the conditions, which are going to be imposed by this Court, and he is ready to cooperate with the investigation. Hence, the petitioner may be enlarged on anticipatory bail.

5. Per contra, learned Additional Public Prosecutor submitted that petitioner had committed grave offence and the investigation is in progress. At this stage, if the petitioner is granted anticipatory bail, he will interfere with the investigation and influence the witness. Hence, prayed to dismiss the petition.

Having considered the rival submissions made by the respective parties and after perusal of the material available on record, it reveals that the petitioner and other accused are manufacturing and supplying the fake educational certificates by engaging agents. The allegations leveled against the petitioner are very serious in nature. Especially, the learned Additional Public Prosecutor basing on the instructions furnished by Sub-Inspector of Police, Filmnagar Police Station, Hyderabad City dated 09.04.2025 has submitted that accused Nos,1,2,9 to 19 were absconding, accused No.3, accused No.4, accused No.6 to accused No.8 are arrested on 18.02.2025 and accused No.5 was arrested on 16.02.2025 and they were not granted bail. According to the learned Additional Public Prosecutor, investigation is under progress.

7. Taking into consideration the facts and circumstances of the case as well as the gravity of the offence, this Court is not inclined to grant anticipatory bail to the petitioner.

8. Accordingly, this Criminal Petition is dismissed.

Miscellaneous applications, pending if any, shall stand closed.
