ORDER:

Heard Smt. V.Yasoda, learned counsel representing Sri G.V.L.Murthy, learned counsel appearing on behalf of the petitioner and Sri G. Sri Chandra, learned Standing Counsel for RMSA, appearing on behalf of the respondents.

2. The petitioner approached this Court seeking the prayer as under:

“…to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the Orders of the 4^th respondent Pro. No.573/A.2015, dt 07.09.2019 terminating the services of the petitioner as Aganwadi Teacher is illegal, arbitrary, violative of principals of natural justice and in uttar violation of the orders of the Hon'ble Court in WP No 851 OF 2019, dt 09.02.2019 and praying this Hon'ble Court for setting aside of the said order dt. 07.09.2019 and consequently direct the respondents to continue the petitioner as angawadi teacher balaramnagar, Kalwakurthy with all consequential benefits arising their form and to pass such other order or orders as this Hon'ble Court may deem fit just and proper in the circumstances of the case.”

The case of the petitioner, in brief, is that the petitioner, an Anganwadi Teacher who served for over 30 years, was terminated from her position vide proceedings dated 17.12.2018 on allegations of misusing nutrition food (Balamrutham) and fabricating beneficiary signatures. Aggrieved by the same, the petitioner challenged the termination in W.P.No.851 of 2019, where this Court vide order dated 19.02.2019 had set aside the termination due to lack of proper inquiry and procedural fairness, directing the respondents to conduct a fresh inquiry. Subsequently, regular enquiry was conducted and based on the enquiry report, the respondent No.3 had issued charge Memo No.573/A/2018 dated 26.04.2019 terminating the petitioner from service on allegation that the petitioner misused the nutrition food (Balamrutham). I t is further the case of the petitioner that the second termination order dated 07.09.2019 is also arbitrary, illegal, and in violation of the principles of natural justice since the inquiry process was flawed, as no personal hearing was afforded, no evidence was examined, and the petitioner’s explanations were disregarded. Aggrieved by the same, the petitioner filed the present writ petition.
