IN THE HIGH COURT FOR THE STATE OF TELANGANA AT HYDERABAD
THE HONOURABLE SRI JUSTICE C.V. BHASKAR REDDY
Depally Narayana – Appellant
Versus
Dr. S. Harish – Respondent
CC 1987/2023

THE HON’BLE SRI JUSTICE C.V.BHASKAR REDDY

ORDER:

This Contempt Case is filed alleging non-compliance of the order dated

23.08.2022 passed by this Court in W.P.No.33108 of 2022.

2. This Court, by an order, dated 23.08.2022 while disposing of W.P.No.33108 of 2022, directed the 2nd respondent to consider the online application bearing No.2200060885 dated 20.06.2022 submitted by the petitioner for rectifying the entry made on online Dharani Portal under land status caption as “Bhoodan land” and to issue pattadar passbook-cum-title deed to the petitioner in respect of land to extent of Acs. 1.18 guntas in Survey No.95/AA2 of the petitioner, situated at Peddashapur Village, Shamshabad Mandal, Ranga Reddy District and pass appropriate orders thereon by duly affording personal hearing to the petitioner within a period of eight (08) weeks from the date of receipt of a copy of the said order. Alleging non-compliance of the said order, this contempt case has been filed.

3. Learned counsel for the petitioner contended that the present contempt case has been filed on 11.09.2023 and even after filing of the contempt case and after receipt of the notice also, the respondents have not complied with the order dated 23.08.2022 passed by this Court in W.P.No.33108 of 2022 and the respondents have neither conducted any survey in respect of land to extent of Acs. 1.18 guntas in Survey No.95/AA2 of the petitioner nor explained the reasons for not conducting the survey.

4. When the matter is taken up for hearing, learned Government Pleader for Revenue appearing for the respondents has placed on record the endorsement dated 29.03.2025 vide Lr.No.D2/2853/2023 issued by the 1st respondent, wherein the petitioner was informed that his application No.2200060885 and 2300005402 filed in Dharani Portal has been rejected as the subject property of the petitioner is in prohibited properties list and the same is claimed by Bhoodan Board.

5. The said endorsement dated 29.03.2025 came to be passed after three years of passing of order dated 23.08.2022 by this Court in W.P.No.33108 of 2022. Thus, the conduct of the respondents in passing the endorsement dated 29.03.2025 after three years of passing of the order dated 23.08.2022 in W.P.No.33108 of 2022 would disentitle them to show any indulgence to exonerate them from the contempt proceedings. Therefore, ends of justice would be met if the 2nd respondent is directed to pay costs of Rs.10,000/- to Devnar Foundation for the Blind.

6. Therefore, the Contempt Case is closed giving liberty to the petitioner to avail the remedies, as available in law, if he is aggrieved by the endorsement dated 29.03.2025 issued by the 1st respondent. The 2nd respondent is directed to pay the costs of Rs.10,000/- (Rupees ten thousand only) to Devnar Foundation for the Blind, Account No.103301000003163, Indian Overseas Bank, Marredpally Branch-103348, Sarva Sukhi Colony, West Marredpally, Secunderabad – 500026 within a period of four (04) weeks from the date of receipt of a copy of this order and proof of payment thereof shall be filed before the Registry.

Miscellaneous petitions, if any, pending shall stand closed.
