ORDER:

The petitioner, who is defendant No.5, is aggrieved by the appointment of an Advocate Commissioner by order dated 19.01.2025. Since 19.01.2025 was Sunday, the case was posted to 20.01.2025 and orders were passed by appointing an Advocate Commissioner and the case was posted on 01.04.2025.

2. On the basis of the representation made by the learned counsel for the petitioner, the Principal Senior Civil Judge, Bhongir, directed the Advocate Commissioner not to execute the warrant and to keep it in abeyance till the order of the Court. According to the civil case, the case stands posted to

29.04.2025.

3. The grievance of the petitioner is that the Advocate Commissioner was appointed without giving him an opportunity to oppose the application. However, the Court has already kept the appointment of the Advocate Commissioner in abeyance until further orders passed by the Court below. In such circumstances, as on date there is no Advocate Commissioner and subject to passing of the orders on 29.04.2025, the Advocate Commissioner will have to act upon his appointment.

4. In the said circumstances, the petition is premature and it is for the petitioner to question the orders that would be passed by the Court below on 29.04.2025.

5. Accordingly, the Criminal Petition is disposed of. It is needless to say that the orders shall be passed by the Court below on 29.04.2025 after hearing both the parties.

Miscellaneous Petitions pending, if any, shall stand closed.
