O R D E R

Heard learned Counsel for the petitioner, the learned Government Pleader for Home appearing for respondent Nos.1 to 3, and with the consent of the learned counsel appearing for the respective parties, the writ petition is taken up for hearing and disposal at admission stage.

The case of the petitioner, in brief, is that she has filed a private complaint under Section 200 Cr.P.C., before the concerned Magistrate, and the same having referred to the respondents- authorities on 28.07.2023, no case has been registered by the 3rd respondent as of date nor the respondent by conducting investigation had submitted the report before the concerned Court, which action of the respondents-authorities it is contended as highly illegal, arbitrary and in dereliction of duties.

3. Per contra, learned Government Pleader appearing on behalf of respondents submits that on the case being referred by the concerned Magistrate, the authorities have registered a case vide FIR.No.510/2023; and that the authorities thereafter by causing preliminary enquiry into the contents of the aforesaid complaint, filed a Final Report, closing the aforesaid complaint as “civil in nature”, before the concerned Court vide SR.No.1163/2025, 4. I have taken note of the respective submissions made.

In view of the aforesaid submissions made and taking note of the fact that the 3rd respondent having already filed a final report in Cr.No.510 of 2023 before the concerned Court, this Court is of the view that the grievance of the petitioner in the present Writ Petition stands redressed. However, if the petitioner is aggrieved by the Final Report filed by the 3^rd respondent before the concerned Court, she has to avail further remedies as provided under Cr.P.C./BNSS.

6. Subject to the above observation and granting liberty as noted above, the Writ Petition is disposed of. No order as to costs. 7. Consequently, miscellaneous petitions, if any, pending shall stand closed.
