THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.4531 OF 2025

ORDER:

The present Criminal Petition is filed by the petitioners-

A.1 and A.2 praying the court to quash the proceedings against them in C.C.No.480 of 2023 pending on the file of Special Judicial Magistrate of First Class at Zaheerabad. The offences alleged against the petitioners are under Section 420 of Indian Penal Code and under Section 7 (1) of Essential Commodities Act.

2. The facts of the case are that on 23.05.2023, the Deputy Tahsildar-2^nd respondent filed report before the police stating that on receiving credible information about illegal transportation of Government PDS rice from Bidar he conducted vehicle check at Gangwar Chowrasta and found 655 different plastic bags containing 295 quintals of PDS Rice. He seized the PDS rice and deposited in MLS Point Godown for safe custody. Basing on the said complaint, the police registered the case against the accused for the said offences.

3. Heard Sri Dasi Ramesh, learned counsel for the petitioners and learned Assistant Public Prosecutor appearing for respondent No.1.
