HON’BLE SRI JUSTICE C.V. BHASKAR REDDY WRIT PETITION No.10660 of 2025

ORDER

This writ petition is filed seeking to declare the action of respondent No.6 in not processing the application No.M/MANC/000220/2020, dated 10.09.2020 of the petitioners to regularize their plot i.e., vacant land admeasuring 299 sq. yards, in Sy.No.283/A2, Block No.1, situated at Mancherial Village, Mancherial Revenue Mandal, Mancherial District, under the Telangana Regularization of Unapproved and Illegal Layout Rules, 2020 (for short, ‘Rules, 2020’) issued by the Government of Telangana, as illegal, arbitrary and consequently prayed for other appropriate reliefs.

2. Considered the submissions of the learned counsel for the respective parties and with their consent, this writ petition is being disposed at the admission stage.

3. It is stated that the petitioners are the joint owners and possessors of the plot i.e., vacant land admeasuring 299 sq. yards, in Sy.No.283/A2, Block No.1, VLT No:1-269/3-17, VLTIN No.1099002884, situated at Mancherial Village, Mancherial Revenue Mandal, Mancherial District, having purchased the same through a registered sale deed vide document No.14114 of 2024, dated 17.12.2024 from their vendor Smt. Rapaka Pavani Reddy. It is further stated that originally Sri Rapaka Prakash Reddy was the absolute owner and possessor of the vacant land admeasuring 5478.60 sq. yards, in Sy.No.283/A2, having acquired the same through a registered partition deed vide document No.9337 of 2017, dated 20.10.2017. It is further stated that Sri Rapaka Prakash Reddy gifted an extent of 299 sq. yards to the petitioners’ vendor Smt. Rapaka Pavani Reddy and subsequently, the petitioners purchased the subject property from her and since the date of purchase of the said property, they have been in continuous and peaceful possession of the same. It is further stated that the Government has introduced Rules, 2020 vide G.O.Ms.No.131 (Department of Municipal Administration & Urban Development), dated 31.08.2020, for regularization of plots in unauthorized layouts on payment of regularization charges and in terms of the said GO and the Rules, 2020, the petitioners’ vendor has submitted an application vide No.M/MANC/000220/2020, dated 10.09.2020, on the file of respondent No.7, by paying the necessary application charges. Hence the present writ petition.

4. Learned Assistant Government Pleader for Revenue has submitted that the petitioners’ vendor has made an application dated 10.09.2020 as per G.O.Ms.No.131, dated 31.08.2020. However, the Government has further issued G.O.Ms.No.28, dated 20.02.2025 revising the policy enunciated under G.O.Ms.No.131, dated 31.08.2020 for regularization of the regularization of plots in unauthorized layouts under the provisions of the Rules, 2020. Therefore, the said application submitted by the petitioners’ vendor has not been considered by the respondent authorities and if the petitioners make a fresh application under the revised GO issued by the Government, the respondent authorities would consider the same.

5. In view of the above, since it is stated that pending adjudication of the application submitted by the petitioners’ vendor, the Government has issued G.O.Ms.No.28, dated 20.02.2025 revising the policy enunciated under G.O.Ms.No.131, dated 31.08.2020 for regularization of the regularization of plots in unauthorized layouts under the provisions of the Rules, 2020, this Court deems it appropriate to dispose of the writ petition permitting the petitioners to make a fresh application for regularization of their plot under the revised policy vide G.O.Ms.No.28, dated 20.02.2025 and if it is found that the petitioners are eligible and fulfills all t
