HON’BLE SRI JUSTICE C.V. BHASKAR REDDY WRIT PETITION No.10590 of 2025

ORDER

It is stated that the petitioner is the owner and possessor of the land admeasuring Ac.0.27 guntas in Sy.No.162/E/1; Ac.0.12 guntas in Sy.No.161E/1 and Ac.0.23 guntas in Sy.No.159E/1, situated at Wallampahad Village, Karimnagar Rural Mandal, Karimnagar District, having purchased the same through registered sale deeds bearing document Nos.11153, 11154, 11155, 11156 and 11157 of 2004. It is further stated that basing on the said sale deeds the name of the petitioner was mutated in all the revenue records and he was also issued pattadar passbook and title deed bearing No.335489 vide Patta No.366 under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 1971 (for short “the ROR Act, 1971”) and the Rules made there under. It is further stated that when the petitioner was not issued new e-pattadar passbook under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2020 (for short “the Act 9 of 2020”), he made online application vide No.2400099331, dated 20.09.2024. The grievance of the petitioner is that even after receipt of the said application, the respondent authorities did not consider the same. Hence, the writ petition.

2. Considered the submissions of the learned counsel for the petitioner and Sri L.Ravinder, learned Assistant Government Pleader for Revenue appearing for respondent Nos.1 to 3 and with their consent, this writ petition is being disposed of at the admission stage.

Learned counsel for the petitioner has vehemently contended that issuance of e-pattadar passbook only consequential act of carrying the entries which have already been made under the provisions of the ROR Act, 1971 and compilation of the survey numbers and the accounts for the extent being mentioned in a particular village, therefore, it does not take away the right of the petitioner in any manner unless the earlier entries in the revenue records have been corrected by following due procedure.

Sri L.Ravinder, learned Assistant Government Pleader for Revenue has not disputed the issuance of earlier passbooks issued in favour of the petitioner under the provisions of the ROR Act, 1971 and also the submission of the application by the petitioner seeking for issuance of e-pattadar passbook.

In view of the above submissions and since it is stated that the petitioner was issued pattadar passbook under the provisions of the ROR Act, 1971 and he made application seeking for issuance of new pattadar passbook under the provisions of the Act 9 of 2020, this Court, without going into merits of the case, deems it appropriate to dispose of the writ petition directing the respondent authorities to examine online application vide No.2400099331, dated 20.09.2024, submitted by the petitioner and if the petitioner satisfied all the requirements for issuance of e-pattadar pass book under the provisions of the Act 9 of 2020 and the circular instructions issued by the CCLA vide circular No.1 of 2021, dated 15.01.2021 and Circular No.1 of 2024, dated 28.02.2024, consider the same and if the petitioner is otherwise not entitled for the same pass a reasoned order in accordance with law and communicate the same to the petitioner, within a period of eight (08) weeks from the date of receipt of a copy of this order.

6. With the above observations, this Writ Petition is disposed of.

There shall be no order as to costs.

7. As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
