WRIT PETITION No.32987 of 2013

ORDER

The Writ Petition is filed seeking a Writ of Mandamus declaring the action of the respondents in restricting the business of the petitioners as wholesale dealers in fertilizers to the District of Nalgonda only as illegal and arbitrary and consequently to direct the respondents not to interfere with the business of the petitioners as wholesale dealers in fertilizers and to pass such other order or orders.

2. Learned counsel for the petitioners submitted that the issue involved in this Writ Petition is squarely covered by the common order passed by this Court in W.P.Nos.6145 of 2013 and batch, dated 29.12.2016 and therefore, prayed to grant a similar order in this Writ Petition as well. A copy of the said common order is also filed before this Court.

3. Heard learned Government Pleader for Agriculture, appearing for the respondents.

4. Having regard to the fact that the issue has already been considered extensively by this Court and has decided as under:

“In view of the above, all the Writ Petitions are allowed by declaring that the petitioners, who are wholesale dealers in fertilizers and obtained acknowledgement and certificate of registration by showing their respective places of sale and storage, are entitled to sell their product outside their districts also, but within the territorial jurisdiction of the concerned State.”

5. In terms of the aforestated order and for the reasons mentioned therein, this Writ Petition is also allowed. There shall be no order as to costs.

6. Miscellaneous applications, if any, pending in this writ petition, shall stand closed.
