ORDER
This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C.’) by the petitioners, seeking to quash the proceedings against them in C.C.No.486 of 2022, pending on the file of learned I Class Additional Junior Civil Judge – Cum – VIII Additional Metropolitan Magistrate, Athvelli Medchal, Medchal Malkajgiri District.
2. After arguing for some time, when this Court has expressed its opinion stating that the said contentions are disputed questions of fact which need to be gone into by the trial Court, learned counsel for the petitioners restricted his prayer to the extent of dispensing with the presence of the petitioners before the trial Court.
3. Hence, without going into the merits of the Case, this Criminal Petition is disposed of holding that, if there are no warrants issued against the petitioners, their appearance before the trial Court is dispensed with unless their presence is specifically required during the course of the trial, subject to the condition that the petitioners being represented by their counsel on every date of hearing.
