ORDER

This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘the BNSS’) seeking quashment of the proceedings against the petitioner in C.C. No.7093 of 2021 on the file of the learned XV Additional Chief Metropolitan Magistrate, Hyderabad.

2. The petitioner is arrayed as accused No.5 in the Calendar Case registered for the offences punishable under Sections 498-A, 406, 420, 494 of the Indian Penal Code, 1860 and Sections 4 and 6 of the Dowry Prohibition Act, 1961.

3. I have heard Mr. Mohd. Fasiuddin, learned counsel for the petitioner and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor, representing respondent No.1-State.

4. Learned counsel for the petitioner submits that the petitioner has no involvement whatsoever in the alleged offences. In particular, the invocation of Section 498-A of the Indian Penal Code (IPC) is wholly inapplicable to her, as she had lawfully obtained a khula divorce and thereby severed all marital and familial ties with the complainant's family.

In light of this significant change in circumstances, learned counsel prays
