ORDER

Heard Sri V. Ravi Kiran Rao, learned senior counsel representing Sri V. Rohit, learned counsel for the petitioners and Sri Kandala Ramakotaiah, learned counsel appearing for the respondents. Perused the record.

2. This revision petition is filed under Section 115 of Code of Civil Procedure (for Short “CPC”) challenging the order dated 20.12.2024 in E.A.No.73 of 2024 in E.P.No.3 of 2016 in O.S.No21 of 2008 passed by learned Judge, Family Court-cum-IV Additional District and Sessions Judge at Karimnagar.

3. Petitioner herein has filed a suit in O.S.No.21 of 2008 against the respondents and others for specific performance of agreement of sale dated 03.04.2008. The same was decreed on 01.04.2015. Thereafter, the petitioner had filed an execution petition vide E.P.No.03 of 2016. During the pendency of the said E.P., the respondents herein have filed an application vide E.A.No.73 of 2024 under Order - 18 Rule - 17 of CPC to recall PW-1 on the following grounds:

(i) The petitioner herein filed a memo dated 30.04.2025 before the trial Court stating that he has paid an amount of Rs.1,37,02,168/- without producing any
