ORDER:
This Criminal Petition is filed by the petitioner/accused No.1, to quash the proceedings in C.C. No.956 of 2015 on the file of Judicial First Class Magistrate, Yellandu, Bhadradri Kothagudem District, for the offences punishable under Sections 417, 493, 494, 294-b and 323 read with 34 of IPC.
2. Heard learned counsel for the petitioner and Sri M.Vivekananda Reddy, learned Assistant Public Prosecutor for respondent – State. Perused the record.
3. The allegation against the petitioner is that he lived by inducing the belief of love marriage.
that the petitioner deceitfully married the de facto complainant and cohabitated with her. Thereafter, he cheated her and also harassed her.
5. The police having investigated into the case, filed the charge sheet against the petitioner for the offences punishable under Sections 417, 493, 494, 294-b and 323 read with 34 of IPC. When once it is alleged that the cohabitation was caused by a person deceitfully inducing a belief of love marriage, the question of attracting Section 494 bigamy, does not arise. Once it is found that no marriage has taken place, invoking Section 494 of IPC that the petitioner has married again, does not arise.
