JUDGMENT:

This appeal is filed against the Order dated

28.04.2008 in O.P.No.805 of 2005 passed by the Motor Vehicles Accidents Claims Tribunal (District Judge) at Nizamabad.

2. The appellant/petitioner filed O.P.No.805 of 2005, claiming compensation of Rs.4,00,000/- for injuries sustained by the petitioner in the road traffic accident occurred on 13.05.2005.

3. Learned counsel for appellant/petitioner stated that on behalf of the petitioner, P.Ws.1 to 3 were examined and Exs.A1 to A10 and Ex.X1 were marked. R.W.1 was examined and Ex.B1 to B3 were marked on behalf of respondents.

4. The Trial Court dismissed the petition. Aggrieved by the said order, the appellant herein preferred the present appeal.

5. Heard both sides. Perused the record.

6. Perusal of F.I.R clearly shows that petitioner is pillion rider and he was travelling along with his brother-in-law on motorcycle bearing No.AP-25/U-3790 from Armoor to Ravutla Village and at about 08.00 P.M, when they reached the outskirts of Bada Bheemgal Village, one tractor bearing No.AP-25/J-0577 came from opposite direction in a high speed in rash and negligent manner dashed the
