HONOURABLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.9977 OF 2025 ORDER : (ORAL)

This writ petition is filed by the petitioner seeking to declare the action of respondent authorities in not cancelling his wrong date of birth certificate inadvertently and erroneously registered under the Book No.12, Sl. No.80, as per the Section 15 of the Registration of Births and Deaths Act, 1969 (for short ‘Act 1969’), as being illegal, arbitrary and unconstitutional.

2. Heard learned counsel for the petitioner and learned Standing Counsel for GHMC, and perused the material on record.

3. The case of the petitioner is that he was born on 12.02.2003 at Pushpa Maternity and Nursing Home vide premises No.16-145/A/9, Judges Colony, Malakpet, Hyderabad. The petitioner is the son of Mr. Nirmal Kumar Rathi and Ms. Monika Rathi. The grandfather of the petitioner by name Mr. Bankatlal Rathi, who was ninety (90) years old then, was the elder person of the Hindu joint family and got the date of birth of the petitioner recorded as 12.05.2003 instead of 12.02.2003. Mr. Bankatlal Rathi expired on 06.12.2006. Thereafter, the petitioner got admission in school and later in college by showing his correct date of birth certificate as 12.02.2003. Subsequently, the petitioner joined R.V. College of Architecture, Bengaluru to pursue five (5) year course of Bachelor of Architecture; the petitioner is pursuing his final year. Even the Aadhar Card and driving licence of the petitioner shows his correct date of birth i.e. 12.02.2003. Having learnt that the petitioner’s date of birth was wrongly registered as 12.05.2003 instead of 12.02.2003 in the birth register under Book No.12, Sl. No.80, the petitioner submitted application dated 24.02.2025 for correction of his date of birth as per the Section 15 of the Act 1969 which deals which the correction/cancellation of entry in the birth/death register. The petitioner has also furnished documentary evidence in support of his claim but so far, his application is not being considered.

4. Learned Standing Counsel for GHMC submitted that appropriate action will be taken on the application submitted by the petitioner in accordance with law.

Recording the aforesaid submission, this writ petition is disposed of directing the respondent authorities to consider the application of the petitioner dated 24.02.2025 for correction of his date of birth as 12.02.2003 which was wrongly recorded as 12.05.2003 in the birth register under Book No.12, Sl. No.80, as per the Section 15 of the Act 1969, by giving opportunity of hearing to the petitioner, and appropriate pass orders in accordance with law, within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
