Learned counsel for the petitioner submitted that building permission application of the petitioner was rejected by the letter dated 26.12.2025 in File No.010896/GHMC/04959/SWBP/SEC2 /2025 stating that the proposed site comes under open space use zone as per the master plan approved by the Government vide G.O.

Ms.No.363 dated 21.08.2010.

3. Learned counsel for the petitioner further submitted that in similar circumstances this Court has passed order dated 01.05.2025 in W.P. No.10815 of 2025, wherein, shortfall with regard to the “open space use zone” has been suspended, by relying on the order passed by this Court in W.P. No.19325 of
