Heard Mr. Ashok Reddy Kanthala, learned counsel for the petitioner; Mr. G. Madhusudhan Reddy, learned standing counsel for the GHMC, appearing for respondent Nos.2 to 5.

Learned counsel for the petitioner submitted that building permission application of the petitioner was rejected by the letter dated 26.12.2025 in File No.010896/GHMC/04959/SWBP/SEC2 /2025 stating that the proposed site comes under open space use zone as per the master plan approved by the Government vide G.O.

Ms.No.363 dated 21.08.2010.

3. Learned counsel for the petitioner further submitted that in similar circumstances this Court has passed order dated 01.05.2025 in W.P. No.10815 of 2025, wherein, shortfall with regard to the “open space use zone” has been suspended, by relying on the order passed by this Court in W.P. No.19325 of 2020 dated 24.04.2023.

4. In paragraph Nos.7 and 8 of the order dated 24.04.2023 in W.P. No.19325 of 2020, it was held as under:

“7.As on the date, the respondents have not acquired the property of the petitioners by initiating proceedings under the provisions of Land Acquisition Act, 2013 by allotting alternative land or payment of compensation for the value of the land, which is required for the purpose of widening of road notified under G.O.MS.320, dated 18.08.2012. Even though the Government has issued masterplan for the Mancherial Municipality by notifying the same in the year 2012, so far, respondents have not taken any steps for implementation of the masterplan, therefore, the petitioners counsel has rightly contended that notification issued by the Government does not take away the right of the petitioners to make application for building permission for construction of the multiplex complex.

8. In view of the above, this Court is of the view that since the petitioners’ land is required for the purpose of widening of 200 feet masterplan, the same shall be acquired by the respondents by duly following the procedure as contemplated under the provisions of Land Acquisition Act, 2013 and in the event of the petitioners’ land is not required for acquisition, the respondents are directed to consider the building application submitted by the petitioners strictly in accordance with law.”

5. In view of the above order passed by this Court in W.P. No.10815 of 2025 dated 01.05.2025 relying upon the order passed by this Court in W.P. No.19325 of 2020 dated 24.04.2023, the objection with regard to the master plan cannot be sustained, and the building permission application of the petitioner cannot be refused on the ground that the proposed site is likely to be affected in the future master plan.

6. Accordingly, the writ petition is allowed, and impugned rejection letter dated 26.12.2025 in File No.010896/GHMC/04959/

SWBP/SEC2/2025 is set aside. Respondent No.5 is directed to reconsider the building permission application of the petitioner in File No.010896/GHMC/04959/SWBP/SEC2/2025 in respect of the property bearing H.No.3-5-199/A-9 & A-10/1 on Plot Nos.A-9, A-10 & A-11 southern portion admeasuring 420 square yards situated at Hari Vihar Colony, Narayanaguda, Hyderabad, without reference to the rejection letter dated 26.12.2025 and without taking objection with regard to the master plan as per G.O. Ms.No.363 dated 21.08.2010. There shall be no order as to costs.

As a sequel thereto, miscellaneous applications, if any, pending in the writ petition stand closed.
