ORDER:

This Writ Petition is filed with the following relief:

“…to issue a writ, order or direction, particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 2 to 5 in not allowing the petitioner to proceed with the construction of building as per the permission vide Permit NO.3006/13262/W18/2018, dated 13.11.2018 issued by the Greater Warangal Municipal Corporation, Warangal as illegal, arbitrary and consequently direct the respondents not to interfere the construction of the building by the petitioner in the aforesaid plot and to pass.......”

2. Heard Mr.A.Prabhakar Rao, learned counsel for the petitioner and Mr.D.Pradeep, learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5.

Learned counsel for the petitioner submits that respondent Nos. 2 to 5 are obstructing the petitioner from proceeding with the construction of a building, despite the fact that the Greater Warangal Municipal Corporation, Warangal, has granted permission vide Permit No. 3006/13262/W18/2018, dated 13.11.2018. Hence, the present writ petition has been filed seeking appropriate directions.

Learned Assistant Government Pleader for Home submits that the respondent police authorities have not interfered with the petitioner’s construction activity as alleged, and that they are conducting themselves strictly in accordance with law. It is contended that the allegations made by the petitioner are unfounded, and accordingly, prays for dismissal of the writ petition.

5. I have perused the material available on record.

6. The grievance of the petitioner is that respondent Nos. 2 to 5, who are the concerned police authorities, are interfering with the petitioner’s construction activity, despite the petitioner having obtained valid permission from the municipal authorities. Such a dispute, on the face of it, is of a civil nature.

7. Having regard to the petitioner’s averments made on affidavit and considering the limited role and jurisdiction of the police authorities in matters pertaining to civil disputes, this Court directs that respondent Nos. 2 to 5 shall refrain from interfering with the construction of the building being carried out pursuant to the permission granted by the Greater Warangal Municipal Corporation, Warangal. However, it is made clear that this order shall not preclude the respondent police authorities from taking any action strictly in accordance with law and by following due process, if any legal necessity so arises.

8. With this direction, this writ petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, pending if any, shall stand closed.
