ORDER :

This Writ Petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

“….to issue a writ of mandamus or any other writ, order or direction declaring the proceedings bearing Proc No D1/815/10/2022 dated 07.12.2022 issued by the Respondent No.2 as being illegal, arbitrary, unconstitutional, in violation of the Telangana Rights in Land and Pattadar Pass books Act, 2020 and in violation of Articles 14 and 21 of the Constitution of India and consequently to set aside the same and direct the Respondent No.2 to mutate the name of the Petitioner in the revenue records on the Dharani portal and issue Pattadar pass book and title deed in respect of land admeasuring Ac.1.30 Gts in Sy.No.679/5 of Bommakal village, Karimnagar Rural Mandal, Karimnagar District.…”

2. Heard Mr. Sriram Polali, learned counsel for the petitioner; Sri L.Ravinder, learned Assistant Government Pleader for Revenue, for respondent Nos.1 to 4; Sri Srikanth Hariharan, learned counsel for respondent Nos.6 and 7; learned counsel for respondent No.9, and perused the record.

Learned counsel for the petitioner submitted that during the pendency of this writ petition, the Telangana Rights in Land and Pattadar Passbooks Act, 2020, has been repealed and replaced by the Telangana Bhu Bharati (Record of Rights in Land) Act, 2025 (for short “the Bhu Bharati Act”), and an Appeal before the appellate authority is constituted under Section 15(5) of the Bhu Bharathi Act, 2025, and hence seeks liberty of this Court for filing an Appeal before the appellate authority.

4. Learned counsel for respondent No.9 would submit that in case if Appeal is preferred by the petitioner, the respondent authorities may be directed to issue notice to the interested parties including respondent No.9.

5. Learned Assistant Government Pleader for Revenue has not disputed the said submissions.

6. In the light of the aforesaid submissions, this writ petition is disposed of granting liberty to the petitioner to file an Appeal before the appellate authority constituted under Section 15(5) of the Bhu Bharathi Act, 2025, who shall, in turn, afford an opportunity of hearing to the petitioner, respondent Nos.5 to 10 and all concerned parties as by procedure established by law and upon examination of the records pass appropriate orders in accordance with law, as expeditiously as possible. Further, so far as the limitation period for filing of Appeal is concerned, the limitation from the date of filing this writ petition to the date of receipt of a copy of this order is condoned. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending, shall stand closed.
