ORDER :

The Writ Petition is filed declaring the action of the respondents in denying promotion to the petitioner on the ground of pendency of disciplinary and criminal proceedings against the petitioner is arbitrary and illegal.

2. Heard Sri V.Ravichandran, learned counsel for the petitioner and the learned Government Pleader for Services-I appearing for respondents. With their consent, this Writ Petition is taken up for disposal at the admission stage itself.

3. The learned counsel for the petitioner submits that the petitioner while working as Deputy Collector, petitioner was issued with (1) Charge Memo dated 19.12.2017 with respect to the incident pertaining to the year 2016, (2) Charge Memo vide G.O.Rt.No.262 Revenue (Vigilance-I) Department dated 12.7.2021 with respect to the incident pertaining to the year 2017 and (3) Charge Memo vide G.O.Rt.No.625 Revenue (Vig.I) Department dated 18.10.2025 with respect to F.I.R.No.05/RCO-CIU-ACB/2020 dated 8.9.2020 on the file of ACB, CIU T.S., Hyderabad and after filing charge sheet, the said matter was taken up by the learned Principal Special Judge for SPE & ACB Cases, Hyderabad vide C.C.No.41 of 2025. It is stated that though the petitioner is in the zone of consideration for the post of Special Deputy Collector, the respondents are not considering her case on the ground of pendency of departmental proceedings and criminal case. Therefore, petitioner seeks indulgence of this Court to direct the respondents to consider the case of the petitioner for promotion to the post of Special Grade Deputy Collector without reference to the departmental enquiry and criminal case.

4. The learned Government Pleader appearing for the respondents submits that since the petitioner is facing departmental enquiry as well as criminal case, she is not entitled for promotion to the post of Special Grade Deputy Collector.

5. Having regard to the submissions made by the respective parties, the writ petition is disposed of, directing the respondents to consider the case of the petitioner for promotion to the post of Special Grade Deputy Collector in terms of G.O.Ms.No.257, General Administration (Ser.C) Department dated 10.6.1999, if she is otherwise eligible, as per law, as and when promotions takes place. Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
