ORDER

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.323 of 2025 before the Makthal Police Station, Narayanpet District, registered for the offences punishable under Section 75(2) and 78(2) of BNS.

The brief facts of the case are that the de facto complainant lodged a report before the Police stating that the petitioner had attempted to outrage her modesty by catching hold of her hand and seeking sexual favour on 26.11.2025 near Karni village. It was stated that similar allegations had earlier been made against the petitioner in Crime No.159 of 2025 and that the present case arose out of the same background and circumstances.

3. Heard Sri B. Bhagath Sain, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent – State.

Learned counsel for the petitioner submitted that the petitioner was falsely implicated due to political rivalry and personal animosity, particularly in the backdrop of local elections, and that the repeated allegations were unsupported by any independent witnesses or corroborative evidence. He further submitted that there were delays and inconsistencies in the earlier complaint, no recovery or material evidence was required, custodial interrogation was unnecessary, and the offences alleged carried a maximum punishment of five years and that the petitioner was a law-abiding agriculturist with deep local roots. Therefore, he prayed the Court to grant pre-

arrest bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious and henious in nature. Further, the investigation was not yet completed. Therefore, at this stage, granting of pre-arrest bail to the petitioner does not arise.

Hence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by the learned counsel on either side and upon a careful perusal of the material available on record, it appears that the allegations leveled against the petitioner are serious in nature. It is evident from the record that even after the earlier registration of Crime No.159 of 2025, the de facto complainant has again lodged the present complaint alleging continued harassment by the petitioner. The investigation is still at an initial stage and granting pre-arrest bail at this juncture may hamper the course of investigation. Therefore, this Court is not inclined to grant pre-arrest bail to the petitioner.

7. Accordingly, this Criminal Petition is disposed of with a direction to the petitioner to surrender before the concerned trial Court and file an application for regular bail. Upon such filing, the trial Court shall consider and dispose of the same expeditiously, on its own merits and in accordance with law.

Miscellaneous applications, if any pending, shall stand closed.
