IN THE HIGH COURT FOR THE STATE OF TELANGANA

AT HYDERABAD

THE HON’BLE SRI JUSTICE K.SARATH

WRIT PETITION No.40449 of 2025

THE 31TH DAY OF DECEMBER 2025

Between:

M/s. Sumukh Agro Industries,

Represented by its Managing Partner, Thatipalli Shoba Rani.

…Petitioner

AND

The State of Telangana, Rep. by its Principal Secretary,

Department of Consumer Affairs, Foods and Civil Supplies,

Secretariat Buildings, Hyderabad and (7) others.

…Respondents

ORDER:

Heard Sri K. Durga Prasad, learned counsel representing

Sri Shankar Polasa, learned counsel for the petitioner, Sri N. S.

Arjun Kumar, learned Government Pleader for Civil Supplies

appearing for the respondent Nos.1, 3, 4 and 8 and

Sri K. Devender, learned Standing Counsel for the Telangana Civil

Supplies Corporation appearing for the respondent Nos.2 and 5.

Perused the material on record.

2. Learned counsel for the petitioner submits that the

petitioner filed the present Writ Petition seeking to declare the

action of the respondent No.6 in passing the order dated

19.12.2025 in No.CS/136/2025-26, blacklisting the petitioner’s

rice mill from participating in future Custom Milling Rice (CMR)

operations for two Kharif marketing seasons as illegal, arbitrary

and contrary to the orders dated 13.11.2025 passed by this Court

in W.P.No.34474 of 2025.

3. Learned counsel for the petitioner further submits that

earlier, the respondent No.6 issued orders dated 04.11.2025 in

No.CS/136/2025-26, blacklisting the petitioner’s rice mill from

participating in future Custom Milling Rice (CMR) operations.

However, the said order dated 04.11.2025 was set aside by this

Court in W.P.No.34474 of 2025, with liberty to the respondents to

follow the due process of law if they intended to pass any order

against the petitioner. Subsequent to the disposal of the Writ

Petition, the respondent Nos.6 passed the present impugned order

dated 19.12.2025 after issuing notice to the petitioner. The

petitioner submitted written explanation by giving detailed replies

to each and every allegation. However, the respondent No.6,

without passing any reasoned order and merely stating that the

written explanation submitted by the learned counsel for the

petitioner was examined but not found convincing, passed the

impugned order blacklisting the petitioner’s mill from participating

in future Custom Milling Rice (CMR) operations for two Kharif

marketing seasons. The impugned order is cryptic and an empty

formality and is liable to be set aside. In view of the same, learned

counsel for the petitioner requested this Court to allow the Writ

Petition by setting aside the impugned order dated 19.12.2025

and remanding the matter to the respondent authorities for fresh

consideration.

4. On the other hand, the learned Government Pleader for Civil

Supplies and the learned Standing Counsel for the Telangana Civil

Supplies Corporation appearing for the respondents, fairly

conceded that the respondent No.6 passed the impugned order

dated 19.12.2025 without providing any reasoned order. They

have expressed no objection to setting aside the impugned order

dated 19.12.2025 with liberty to the respondent authorities to

pass reasoned orders in accordance with law, taking into

consideration the submissions made by the petitioner in

explanation dated 12.12.2025 submitted through their counsel.

In view of the same, requested to pass appropriate orders.

5. In view of the submissions made by both sides, this Writ

Petition is disposed of by setting aside the impugned order in

No.CS/136/2025-26 dated 19.12.2025. Consequently, the matter

is remanded to the respondent authorities for re-consideration of

the written explanation made by the petitioner on 12.12.2025 and

to pass reasoned orders thereon and communicate the same to

the petitioner within a period of two (2) weeks from the date of

receipt of a copy of this order.

Miscellaneous Applications, if any, pending in this Writ

Petition, shall stand closed. There shall be no order as to costs.
