ORDER
The writ petition is filed seeking to declare the
action of the respondent in issuing the notice dated
19.01.2011 to the petitioner, purportedly under Sections
521 and 622(4) of the Hyderabad Municipal Corporation
Act, 1955, and demanding Rs.1,44,000/- each towards
licence fee and garbage charges, as illegal and arbitrary.

2. Heard Sri Maddela Ravinder, learned counsel
appearing on behalf of the petitioner and Sri Midde Arun
Kumar, learned Standing Counsel for GHMC appearing
on behalf of the respondent.
3. On 21.01.2011, this Court passed interim stay of
all further proceedings pursuant to notice dated
19.01.2011 and on 11.03.2011, the said order is
extended until further orders.
4. Learned counsel appearing on behalf of the
petitioner submits that the cause of action in the present
writ petition still survives for adjudication.
5. Though the writ petition pertains to the year 2011,
the respondent has not filed a counter, thus, nothing has
been placed to disbelieve the contentions of the
petitioner, and the interim order is operating as on date.
6. Accordingly, the writ petition is disposed of in terms
of the interim order passed by this Court on 11.03.2011.
However, if the respondents intend to take any action,
they shall follow due process of law by issuing a fresh

notice by putting the petitioner on notice and shall also
follow due procedure of law in accordance with the
provisions of the GHMC Act, 1955. There shall be no
order as to costs.
As a sequel thereto, miscellaneous petitions, if any,
pending shall stand closed.
