ORDER:

This Writ Petition is filed declaring the action of the

respondents in not concluding the disciplinary proceedings

against the petitioner arising out of G.O.Rt.No.203, INC(V)

Department, dated 30.12.2024 as arbitrary and illegal and not

considering the case of the petitioner for promotion.

2. Heard learned counsel for the petitioner and the learned

Government Pleader for Services-III appearing for respondents.

With their consent, this Writ Petition is taken up for disposal

at the admission stage itself.

3. The learned counsel for the petitioner submits that the

petitioner while working as Surveyor in Ranga Reddy

District, a charge Memo was issued to him by the

vide

respondent No.1 G.O.Rt.No.198, Industries and

Commerce (Vigilance) Department dated 30.12.2024

levelling two charges, for which petitioner has submitted his

written statement on 13.02.2025, denying the charges.

However, without considering the same, an enquiry was

ordered, but there is no progress in the enquiry. It is further

submitted that the petitioner is eligible and entitled for

promotion to the post of Supervisor, but the respondents

are not considering his promotion on the ground of

pendency of the said charges. Therefore, petitioner seeks

indulgence of this Court to direct the respondents to

consider his case for promotion to the post of Supervisor in

terms of G.O.Ms.No.257, General Administration (Ser.C)

Department dated 10.06.1999.

4. The learned Government Pleader appearing for the

respondents submits that since the petitioner is facing

departmental proceedings, he is not entitled for promotion,

however, the respondents will consider the case of the

petitioner for promotion to the post of Supervisor in terms of

G.O.Ms.No.257 dated 10.06.1999.

5. Having regard to the submissions made by the

respective parties and without going into the merits of the

matter, the writ petition is disposed of, directing the

respondents to consider the case of petitioner for promotion

to the post of Supervisor in terms of G.O.Ms.No.257,

General Administration (Ser.C) Department dated

10.06.1999, as and when promotion takes place. There shall

be no order as to costs.

Miscellaneous applications pending, if any, in this Writ

Petition, shall stand closed.
