ORDER :

This writ petition is filed by the petitioner seeking to declare

the action of respondent No.2 in issuing the revocation notice vide

Lr.No.247925/SIRC/0011/2023 dated 15.02.2023 cancelling the

building permission application of the petitioner vide application

No.247925/SIRC/0011/2023 dated 04.01.2023 in respect of the

open plot bearing H.No.2-6-44 admeasuring 62.11 square yards

situated at Sanjeevaiah Nagar, Siricilla Village and Mandal, Rajanna

Siricilla District, without issuing any notice, as being illegal,

arbitrary and contrary to the provisions of the Telangana

Municipalities Act 2019.

2. Heard Mr. Nimmaraboina Naveen, learned counsel for the

petitioner, and Mr. Putta Krishna Reddy, learned standing counsel

for respondent No.2.

3. The case of the petitioner is that he is the absolute owner and

possessor of the subject property. He obtained building permission

through self-certification vide application No.247925/SIRC/0011

/2023 dated 04.01.2023 for construction of Stilt for parking + two

(2) upper floors. Respondent No.2 without issuing prior notice

revoked the building permission application vide letter dated

15.02.2023. It is submitted that the petitioner acquired the subject

property from his ancestors. Originally, the grandfather of the

petitioner owned the house in the open land admeasuring 181.8

square yards in Survey Nos.1479 and 1480 situated at Sanjeeviah

Nagar, Siricilla Town and Mandal, Rajanna Siricilla District.

He died leaving behind three (3) sons including the father of the

petitioner, who was allotted the subject property towards his share.

While so, notice vide Roc.No.G1/1967/2024 dated 03.10.2024 was

issued to the petitioner stating that representation was received from

respondent No.3 on 26.09.2024 alleging unauthorized construction.

The petitioner was directed to submit ownership documents, link

documents, permission documents, court case details or court orders

etc. within a period of seven (7) days from the date of receipt of that

notice.

4. Learned counsel for the petitioner submitted that all the

requisite documents have been submitted by the petitioner to

respondent No.2. In fact, respondent No.3 instituted a suit in

O.S. No.203 of 2022 on the file of learned Principal Junior Civil

Judge at Siricilla seeking perpetual injunction restraining the

petitioner and one Ms. Bitla Sunanda from interfering with the

possession and enjoyment over the land admeasuring Ac.0-01 gunta

or 121 square yards bearing H.No.2-6-54/1 in Survey Nos.1479,

1480 and 1503 situated at Siricilla town. The suit is pending for

adjudication and there are no interim orders passed. The petitioner

submitted application under RTI Act 2005 on 30.01.2025 requesting

to furnish orders if any passed pursuant to the notice dated

03.10.2024. Thereafter, respondent No.2 furnished information vide

No.G1/RTI /17/2025 dated 17.02.2025 annexing copy of notice

dated 03.10.2024 issued by respondent No.2, whereby the petitioner

was directed to submit ownership/link documents, permission, court

case details or orders etc.

5. It is the contention of the learned counsel for the petitioner

that having failed to obtain any interim orders from the competent

civil court, respondent No.3 lodged a false complaint before

respondent No.2 seeking cancellation of building permission.

W.P. No.38198 of 2025 was filed by the petitioner questioning the

action of respondent No.2 in interfering with the construction

activity undertaken by the petitioner pursuant to the building
